A Las Vegas school bus driver has been arrested on charges of lewdness with a child under the age of 14. The charges stemming from his alleged crime under NRS 201.230 are just the beginning of his legal woes. Michael Banco also faces felony kidnapping, child sexual assault and child abuse charges. If Banco is convicted of these crimes, he may be facing a penalty of life in prison.
Lewdness with a child is a serious offense. At a basic level NRS 201.230 makes it illegal to touch a person under the age of 14 for a sexual purpose. It isn’t necessary for the alleged offender to touch the child’s sexual organs. Instead, touching a child anywhere may be illegal if the touching is performed with sexual intent. A person who is convicted for a violation of 201.230 is required to register as a sex offender for the rest of their life.
There are many defenses to accusations of lewdness with a child under 14 in Nevada. Perhaps there was no sexual intent or maybe the child made a false accusation. Regardless, these situations are always painful and complicated.
If you have been accused of lewdness with a child, you need competent legal representation to defend your rights in court.
