Assault and battery are frequently heard terms, and though many people think they are the same crime, this is a fallacy. They are two distinct crimes, but often a person is charged with both at the same time.

Assault is a threat to inflict physical harm, while battery refers to actual physical contact. Accordingly, assault may mean stating an intent to punch someone. Battery occurs when the punch makes contact with the victim. Battery charges are further defined into different classes, with more serious charges resulting in stiffer penalties.

Being charged with assault and/or battery is serious. It is only with experienced criminal defense that anyone can hope to protect their rights in court.
